Rewards Agreement

Important information about program and agreement

Your ComCard charge card comes with membership in a rewards program that can generate cashback, points, or any other rewards that you as a customer can redeem. Your account will participate in the program as long as it is active and in good standing.  Presently, rewards are only eligible to be redeemed as a statement credit directly applied to your account. 

You agree that use of your account or any feature of this program indicates your acceptance of the terms of this agreement. In this document, the following words have special meanings: 

  • “agreement” means this document 

  • “program” means this ComCard Rewards program 

  • “account” means your credit card account at ComCard

  • “card” means any credit card or account number used to access your account 

  • “we,” “us,” “our,” and “ComCard” mean ComCard, Inc. and its affiliates 

  • “you” and “your” mean the person responsible for the account and for complying with this agreement

  • “authorized user” means anyone you permit to use the account

  • “purchases” is defined in the section of this agreement titled How you can earn points

We may make changes to the program and the terms of this agreement at any time.For example, we may: 

  • add new terms or delete terms 

  • change how you earn rewards

  • change how you use rewards

  • change what you can get with your rewards

We may temporarily prohibit you from earning rewards, using rewards you’ve already earned, or using any features of the program.

We may supplement this agreement with additional terms, conditions, disclosures, and agreements that will be considered part of this agreement.  We may update or replace this agreement with you by posting an updated version to our legal page.  

You may only withdraw consent to participate in the rewards program by closing your ComCard Account.

How you can earn rewards

You’ll earn points when you, or an authorized user, use a card to make purchases of products and services, minus returns or refunds (collectively, the “purchases”). The rewards program is described in more detail at our website. Buying products and services with your card, in most cases, will count as a purchase; however, the following types of transactions won’t count and won’t earn rewards:

  • balance transfers

  • cash advances

  • travelers checks, foreign currency, money orders, wire transfers or similar cash-like transactions

  • lottery tickets, casino gaming chips, race track wagers or similar betting transactions

  • any checks that access your account

  • Interest

  • unauthorized or fraudulent charges

  • fees of any kind, including an annual fee, if applicable

In order to earn rewards, you have to make a purchase with a ComCard card within ComCard Rewards partners who participate in your industry rewards program. You can find participating partners at comcard.us or on the ComCard Mobile App.

Rewards may vary from partner to partner and depends on your purchasing activity with a participating partner.

We determine eligibility by comparing data provided by the payment processor in accordance with MasterCard procedures. We may adjust configuration at any time to improve the quality of service. If you didn’t receive rewards as part of an eligible purchase at a  participating partner listed in your account, please contact ComCard support.

Other information about the earning and availability of rewards

Rewards are earned at the close of each monthly billing cycle, based on the purchases made during that billing cycle, plus any bonus rewards posted during that billing cycle, minus any returns or refunds. If you have more returns or refunds than rewards earned from purchases or bonuses, then rewards will be deducted from your total rewards balance and may result in a negative rewards balance.

You’ll see points you’ve earned on comcard.us and on your monthly card billing statement. 

Rewards earned in a monthly billing cycle are generally available to be used at the beginning of the next billing cycle; however, rewards earned on purchases made near the end of a billing cycle may take up to one additional billing cycle to become available. 

How you could be prohibited from earning or using rewards

We may temporarily prohibit you from earning rewards or using rewards you’ve already earned:

  • if you don’t make the minimum payment on your account before the due date.

  • if we suspect that you’ve engaged in fraudulent activity or engage in prohibited activities related to your account or the program.

  • if we suspect that you’ve misused the program in any way, for example:

    • by buying or selling rewards

    • by moving or transferring rewards to an ineligible third party or account

    • by repeatedly opening or otherwise maintaining credit card accounts for the purpose of generating rewards

  • You can begin earning and using rewards again in the next billing cycle after your account becomes current or when we no longer suspect fraud or misuse of the account or program.

How you could lose your points

Your points don’t expire as long as your account is open, however, you’ll immediately lose all your points if your account status changes or your account is closed, for any of the following reasons:

  • you don’t make the minimum payment on your account within 30 days of the due date

  • you fail to comply with this or other agreements you have with ComCard

  • we believe you may be unwilling or unable to pay your debts on time

  • you file for bankruptcy

  • we believe that you’ve engaged in fraudulent activity or engage in prohibited activities related to your account or the program

  • we believe that you’ve misused the program in any way, for example:

    by buying or selling rewards

    • by moving or transferring rewards to an ineligible third party or account

    • by repeatedly opening or otherwise maintaining credit card accounts for the purpose of generating rewards

If your account is closed for any other reason, you’ll have at least 30 days from the date your account is closed to use your points, as long as you don’t lose them for any of the reasons described in this agreement. If you don’t use your points during that time, you’ll lose them.

If we decide to cancel the program, you’ll have at least 30 days from the date we cancel the program to use your points, as long as you don’t lose them for any of the reasons described in this agreement. If you don’t use your points during that time, you’ll lose them.

If we’re notified of the company’s dissolution, you’ll lose rewards.

We won’t reinstate points you lose unless we’ve made an error.

Privacy

You are required to provide some company information that can be shared with third parties in order to receive rewards. Please review our Privacy Policy, the Platform Agreement, and your Card Account Terms and Conditions and contact us if you have any questions.

Other important information you should know

Rewards aren’t your property and have no cash value. You can’t transfer or move points unless expressly provided for in this agreement.

Your participation in the program may result in the receipt of taxable income from ComCard and we may be required to send to you, and file with the IRS, a Form 1099-MISC (miscellaneous income). You are solely responsible for any tax liability, including disclosure requirements, related to participating in the program. Please consult your tax advisor if you have any questions about your tax situation. 

The program is void where prohibited by federal, state, or local law.

This agreement will be construed, applied, and governed by the laws of the State of California exclusive of its conflict or choice of law rules except to the extent that US Federal law controls. Subject to this, all disputes will be resolved in the manner described in the Platform Agreement between Company and ComCard.

We may enforce the terms of this agreement at any time. We may delay enforcement without losing our right to enforce this agreement at a later time. If any term of this agreement is found to be unenforceable, we may still enforce the other terms.

THE REWARDS PROGRAM IS PROVIDED TO YOU AS IS. COMCARD DISCLAIMS ALL EXPRESS, IMPLIED, OR STATUTORY WARRANTIES OF TITLE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NOTHING IN THIS REWARDS AGREEMENT WILL BE INTERPRETED TO CREATE OR IMPLY ANY SUCH WARRANTY TO YOU.

REWARDS PROVIDED BY THIRD PARTIES ARE NOT PROVIDED OR CONTROLLED BY COMCARD. COMCARD DOES NOT PROVIDE SUPPORT FOR AND DISCLAIMS ALL LIABILITY ARISING OUT OF, RELATED TO OR RESULTING FROM FAILURES OR LOSSES CAUSED BY SUCH REWARDS OR THEIR FULFILLMENT BY THIRD PARTIES.

COMCARD DISCLAIMS ALL WARRANTIES AND DOES NOT GUARANTEE THAT: (A) POINTS OR REWARDS WILL PROVIDE ANY VALUE OR BENEFIT TO COMPANY OR USERS; (B) REWARDS FULFILLED BY THIRD PARTIES WILL BE PROVIDED IN THE MANNER DESCRIBED; (C) ANY ERRORS OR DEFECTS IN THE REWARDS PROGRAM WILL BE CORRECTED, EVEN WHEN WE ARE ADVISED OF SUCH DEFECTS.

Our maximum liability to you for direct damages under this agreement is limited to the lesser of any amounts paid by you to ComCard for Rewards in the three months preceding the event that is the basis of your claim or $100. ComCard is not liable to you for consequential, indirect, special, or punitive damages, lost profits or revenue whether or not you advised us of their possibility. These limitations will apply regardless of the legal theory on which your claim is based.

You agree to indemnify and defend ComCard (including our affiliates, employees, contractors, and third-party service providers) against losses, claims, damages, liabilities, or expenses that result from or are related to claims, proceedings, suits, or actions brought by or initiated against ComCard by any third party due to your breach of this agreement, or an your administrators’ or users’ breach of obligations owed under this agreement; for acts or omissions of your administrators, users, or any of your other employees or agents; or disputes  between you and third parties that fulfill rewards.  

Notice of changes 

We’ll give you 30 days notice of the following types of changes to the program or this agreement: 

  • if we add or increase fees applicable to the program

  • if we limit the number of rewards you can earn

  • if we cancel the program

We’ll send this notice to you in writing, which, at our option, may be delivered to you electronically by email or through our online services, such as comcard.us or the ComCard Mobile App. 

Presently, rewards are only eligible to be redeemed as a statement credit directly applied to your account. We may change this in the future and will notify you about changes within the standard 30 days.
